Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Marketology ("we," "us" or "our"), concerning your access to and use of our website and services.

You agree that by accessing our website and/or services, you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using our website and services and must discontinue use immediately.

Services

Marketology provides digital marketing and content creation services for businesses in the social care sector. Our services include, but are not limited to, digital marketing campaigns, content creation, Google Business Optimisation, and performance reporting.

We reserve the right to refuse service to anyone for any reason at any time.

Billing and Payment

All plans are billed on a quarterly basis. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a 3-month basis.

At the end of each Billing Cycle, your subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it. You may cancel your subscription renewal either through your online account management page or by contacting our customer support team.

A valid payment method, including credit card, is required to process the payment for your subscription. You shall provide us with accurate and complete billing information, including full name, address, state, postal code, telephone number, and valid payment method information. By submitting such payment information, you automatically authorize us to charge all subscription fees incurred through your account to any such payment instruments.

Should automatic billing fail to occur for any reason, we will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.

Cancellation and Refunds

You can cancel your subscription at any time by contacting our customer support team or through your account settings. Your cancellation will take effect at the end of the current Billing Cycle.

Except when required by law, paid subscription fees are non-refundable. No refunds or credits will be provided for partial periods of service, downgrade refunds, or refunds for periods unused with an active subscription, including if you stop using our services before the end of your current Billing Cycle.

Intellectual Property

The website and its original content, features, and functionality are and will remain the exclusive property of Marketology and its licensors. The website is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Marketology.

Content created for clients as part of our services becomes the property of the client upon full payment of the associated fees, subject to any third-party licenses that may be incorporated into the deliverables.

User Representations

By using our website and services, you represent and warrant that:

1. All registration information you submit will be true, accurate, current, and complete.
2. You will maintain the accuracy of such information and promptly update such registration information as necessary.
3. You have the legal capacity and you agree to comply with these Terms of Service.
4. You are not a minor in the jurisdiction in which you reside.
5. You will not access the website or services through automated or non-human means, whether through a bot, script, or otherwise.
6. You will not use the website or services for any illegal or unauthorized purpose.
7. Your use of the website or services will not violate any applicable law or regulation.

19. 20. Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the website, or using or launching any unauthorized script or other software.
21. Disparage, tarnish, or otherwise harm, in our opinion, us and/or the website.
22. Use the website in a manner inconsistent with any applicable laws or regulations.

Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the website or services, even if we have been advised of the possibility of such damages.

Indemnification
